Definitions

The LampPost Project: an independent online shop that retails totebags created by a few designers using recycled material and is a project of DDB Worldwide Pte Ltd, which is incorporated under the laws of Singapore and whose registration number is 198602528W, and whose registered address is at Level 10, Pico Creative Centre, 20 Kallang Avenue, Singapore 339411.

Customer: any person who would purchase or like to purchase any goods or services from The LampPost Project and enter into a contract for the same.

Contract: an agreement, digital or otherwise, concerning goods or services concluded between a customer and The LampPost Project that are made available through www.lamppostyle.com.

Materials: the Website, information on it, materials on it, and arrangements.

Trademarks: a collective term for The LampPost Project logo and other marks.

 

 

Overall

The following General Terms and Conditions apply to all offers made by or on behalf of The LampPost Project, as well as to all contracts between The LampPost Project and a customer.

If the contract is concluded with a party that is not a customer, these general terms and conditions shall apply equally, unless stated otherwise.

Before any contract is concluded, the General Terms and Conditions shall be made available to the customer. The General Terms and Conditions shall also be available at the website of the shop.

The customer must be at least 18 years of age to enter into a contract with The LampPost Project. The LampPost Project reserves the right not to enter into a contract with a customer without giving any reason whatsoever.

The General Terms and Conditions may be amended at the sole discretion of The LampPost Project at all times and without prior notice.

No part or parts thereof may be reproduced, distributed, copied, adapted, modified, republished, displayed, broadcast, performed, transferred, sold, hyperlinked, framed, transmitted or be used to create derivative works from, in any manner or any means or stored in an information retrieval system without the prior written permission of The LampPost Project.

No insertion of a hyperlink to this Website or “mirroring” or framing of any Material contained in this Website on any other server without the prior written permission of The LampPost Project.


 

Trademarks

The LampPost Project has exclusive rights to use the Trademarks.

Nothing on this Website should be construed as granting, by implication, estoppel or otherwise, any licence or right to use any of the Trademarks displayed on this Website.

The name The LampPost Project and Trademarks may not be used in any way whatsoever without the prior written permission of The LampPost Project.

The LampPost Project prohibits the use of the Trademarks as a “hot” link or deep link to any site, unless the establishment of such link is approved in writing in advance, by The LampPost Project in writing.


 

Contracts

A contract is concluded at the time of acceptance by the customer of the offer by The LampPost Project and the compliance by the customer of the conditions of the offer.

The LampPost Project will send an e-mail to confirm the conclusion of the contract and the terms thereof. This confirmation shall include the name and address of The LampPost Project, a description of the product, the price including any taxes, delivery costs, the customer’s right of withdrawal and the conditions thereof.

All goods and services in the shop are subject to availability.

Many products in the shop are unique works of art and may already be sold out at the time when a contract for the product concerned is concluded.

In that event The LampPost Project will inform the customer thereof as soon as possible. Any payment that has already been made will be refunded as soon as possible.

Not all products listed in the shop may be available for sale and The LampPost Project reserves the right to withdraw any product from the shop at all times.


 

Payment

All prices listed in the shop are in Singapore Dollars (SGD) and, unless indicated otherwise, inclusive of any GST and other taxes or levies. Local delivery cost is included in the listed.

All payments must be made prior to delivery by using one of the payment methods indicated in the shop.

The LampPost Project reserves the right to change the price of the products and of the delivery costs at all times prior to the acceptance by the customer.

If fraudulent use has been made of the customer’s payment card in connection with a contract, the customer can send a request by e-mail to The LampPost Project to cancel the payment.

Unless the fraudulent use was caused by circumstances for which the customer is responsible, The LampPost Project shall immediately refund the purchase price paid by the customer, as soon as the customer has returned the products to The LampPost Project at his own expense.


 

Proceeds

The LampPost Project is a non-profit project. Proceeds are channelled to charities selected by The LampPost Project such as Singapore Association of Mental Health (SAMH).

Proceeds are net of production costs, transaction fee, delivery charges and GST.

The LampPost Project reserves the right to change the charity organization from time to time, without prior notice.


 

Warranty

The LampPost Project shall describe all products as accurately as possible and warrants that the products shall comply as accurately as possible with its specifications as agreed upon in the contract.

The customer accepts that, since the products listed in the shop may be unique works of art, their description may not be accurate and/or that the product concerned does not have the functional specifications that it may appear to have or that are mentioned or suggested in its description.

The customer also accepts that since the products use recycled materials salvaged from lamp posts, the materials cannot be expected to be brand new and in perfect condition.

The LampPost Project does not warrant that the product shall comply with all applicable legislation or that it is in accordance with the law of the country of residence of the customer to purchase and import the product in that country.

The customer is aware and acknowledges that the products, which are works of art may not or no longer comply with any regulations that might apply or have applied to the materials from which the product was created.

The LampPost Project warrants that to the best of its knowledge the product does not infringe any copyright, trademark, design, patent, or any other right of intellectual property of any third party and that The LampPost Project is authorised to sell and deliver the product to the customer.

Any liability of The LampPost Project in this respect shall be limited to the amount of the purchase price of the product concerned.

The sale and delivery of the product shall not constitute any assignment or transfer of rights to the customer.

All rights of intellectual property with regard to the product shall remain with The LampPost Project and/or its licensors.

 

 

Delivery

The LampPost Project shall determine at its full discretion the country or countries to which the products may be delivered. This may vary per product and The LampPost Project reserves the right to change the countries to which the products are delivered at all times.

All deliveries shall be made within 30 days after the date on which the contract was concluded and all payments made, unless The LampPost Project indicates otherwise.

If the delivery is delayed or if the product cannot or can no longer be delivered, The LampPost Project shall inform the customer accordingly by e-mail as soon as possible but no later than 30 days after the date of the contract.

In the event that the delivery is delayed for more than 45 days after the date of the contract or if The LampPost Project informs the customer that the product cannot be delivered, the customer has the right to dissolve the contract free of charge.

The purchase price and delivery costs paid shall be refunded as soon as possible but no later than 30 days after the dissolution of the contract.

The customer shall not be entitled to free delivery of a replacement product. The sole remedy of the customer shall be a full refund of the purchase price and delivery costs.

In no event shall The LampPost Project be liable for any kind of damages allegedly suffered by the customer as a result of the fact that the product could not be delivered or not be delivered in time.

Immediately upon receipt of the product, the customer shall inspect the product and check if the product complies with the agreed specifications. 

Any apparent failure of or damage to the product must be reported by e-mail to The LampPost Project within 15 days after delivery, failing which the customer shall be deemed to have accepted the product and to have waived the right to claim any shortcomings of the product.

Once the product has been accepted, requests for returns, refunds and exchanges will not be entertained.

Customer requests for exchange of T-shirt sizes are subject to product availability. Refunds will not be provided.

 

 

Privacy and data protection

The LampPost Project shall process all personal data of the customer in accordance with applicable laws and shall not in any way make this information available to any third party and for any other purpose.

The LampPost Project shall be allowed to use the customer’s personal data for its own direct marketing purposes, if the customer has given his permission when the contract was concluded (opt-in).

The customer may withdraw his permission at all times and may request The LampPost Project to change or remove the registered personal data.

 

 

Customer service

All communications by the customer with regard to the contract and/or the product purchased must be made by e-mail to the following address: hello@lamppostyle.com.

The LampPost Project shall give its best effort to reply to an e-mail within seven working days.

The customer shall inform The LampPost Project of any change of his address and e-mail address.


 

Modification of Website and Terms of Use

The Materials contained in this Website and the Terms of Use and descriptions that appear are subject to change at the sole discretion of The LampPost Project at all times without prior notice.
 

 

No unlawful or prohibited use

As a condition of your access to this Website, you warrant to The LampPost Project that you will not use this Website for any purpose that is unlawful or prohibited by these Terms of Use.

As a condition of your purchase of any product from The LampPost Project, you agree to observe the full respect for all state emblems, symbols, images and designs.

Any worn out or damaged bag should be disposed of properly and not left visible in dustbins.

 

 

Liability disclaimers

The Materials contained in this Website (including text, images, graphics, links, sound files, animation files, video files or other items and their arrangements) are provided “as is”, “as available”. The LampPost Project does not warrant the accuracy, adequacy or completeness of these Materials.

No warranty of any kind, implied, expressed or statutory, including but not limited to the warranties of non-infringement of third party rights, title, satisfactory quality, merchantability, fitness for any particular purpose and freedom from any computer virus or other malicious, destructive or corrupting code, programme or macro, is given in conjunction with the information and Materials contained in or linked to this Website.

This Website may include publications with technical inaccuracies or typographical errors that will be corrected as they are discovered at The LampPost Project’s sole discretion. Also, changes are periodically added to the Materials contained herein.

These corrections and changes may be incorporated into the Website at a later date. The LampPost Project may at any time make modifications, improvements and/or changes to these Terms of Use and the Materials (names, images, pictures, logo and icons) displayed on the Website or products and services referred to within, with or without notice.

Advice received via this Website should not be relied upon for personal, legal or financial decisions and you should consult the appropriate professional for specific advice pertaining to your situation/circumstance.

The LampPost Project shall in no event be liable for any damages, loss or expense, including without limitation, special damage, consequential damage or economic loss arising from or in connection with:

The Website may contain links to or references to other websites that may be accessed or which may originate outside the boundaries of the Website and over which information The LampPost Project will have no control.

Therefore, The LampPost Project shall have no obligation or responsibility regarding any content derived, obtained, accessed within through or outside of the Website.

The LampPost Project’s inclusion of links to such websites does not imply any endorsement or verification of the Materials on such websites or any association with their operators, and such websites shall be accessed at the user’s own risk.


 

Miscellaneous

If any clause of the general terms and conditions or the contract would be invalid, void or for any other reason unenforceable, the validity and enforceability of all remaining clauses shall not be affected.

Any amendment to the contract must be made in writing and duly signed by the customer and an authorised representative of The LampPost Project.

The contract shall not be subject to any other terms than expressly mentioned in these terms and conditions. General purchase terms or other terms and conditions of the customer or of any group or organization shall not apply to the contract.


 

Applicable law and disputes

By accessing this Website and/or using the Materials, facilities and/or services offered through this Website, you agree that Singapore laws shall govern and you agree to submit to the non-exclusive jurisdiction of the Singapore.
